Amiriu Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Amiriu website (www.amiriu.com, including all subdomains, content, and services offered through the site, collectively the “Site”). Amiriu (“we,” “us,” or “our”) provides the Site to enable users to browse, search, and purchase men’s and women’s ready-to-wear, shoes, leather goods, and accessories, as well as access related content (e.g., product descriptions, images, reviews). By accessing or using the Site, you (“you” or “user”) agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.

1. Eligibility to Use the Site

To use the Site, you must:

  • Is your original work, and you have the right to share it with us (you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute the UGC on the Site or in our marketing materials, with attribution to your username if desired).
  • Does not violate any third-party rights (e.g., copyright, trademark, privacy, or publicity rights) — you will indemnify us against any claims arising from infringement of these rights.
  • Is not false, misleading, defamatory, harassing, discriminatory, violent, pornographic, or illegal, and does not promote hate speech, harm to others, or unlawful activities.

We reserve the right to review, edit, or remove any UGC at our discretion, without prior notice, if we believe it violates these standards or these Terms.

The “Amiriu” name and logo are trademarks of Amiriu. You may not use these trademarks or any confusingly similar marks without our explicit consent.

The Site may contain links to third-party websites, services, or content (e.g., social media platforms, payment processors, or shipping carriers). These links are provided for your convenience only, and we do not control or endorse the content, privacy policies, or practices of these third parties.

6. Site Availability & Technical Issues

We strive to make the Site available 24/7, but we do not guarantee uninterrupted access. The Site may be temporarily unavailable due to:

  • Technical failures (e.g., server outages, internet connectivity issues, or software bugs).

  • Our total liability to you for any claims related to the Site (whether in contract, tort, or otherwise) shall not exceed $100 USD, or the amount you paid for products through the Site in the 12 months prior to the claim (whichever is higher).

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of, United States, without regard to its conflict of laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration award shall be final and binding, and may be enforced in any court of competent jurisdiction.

You agree that you will not bring any class action, collective action, or representative action against us related to these Terms or the Site.

12. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and Amiriu regarding your use of the Site, and supersede all prior or contemporaneous agreements, communications, or understandings (whether oral or written).
  • Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or any other provision.
  • Assignment: You may not assign these Terms or your rights/obligations under them to any third party without our prior written consent. We may assign these Terms to a third party (e.g., in the event of a merger, acquisition, or sale of assets) without your consent.
